      My-cpd will store your evidence for a period of 28 days (from the end date of your free trial) after which time it will be deleted.

    1. Terms

    This is a legal agreement (“Agreement”) between you and my-cpd Ltd, hereafter referred to as my-cpd. Please read this agreement carefully before accessing or using the my-cpd website. By accessing the my-cpd website, currently located at www.my-cpd.co.uk, and or using any of the services (as defined below) accessible through the Site, you become a user and agree to, and are bound by, the terms and conditions of the Agreement for as long as you continue to use the Site or Services. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT USE OUR SERVICES. Your use of or participation in , certain Services may be subject to additional terms, and such terms will either be listed in this Agreement or will be presented to you for your acceptance when you sign up to such Services.

    The following terms and conditions govern all use of the my-cpd website and all content, services and products available at or through the website. The website is owned and operated by my-cpd Limited. The website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, my-cpd's privacy policy) and procedures that may be published from time to time on this website by my-cpd (collectively, the “Agreement”).

    2. User Licence

    As a user of the Site or a user registered to use any of the Services, you agree to the following:

    Your account is for your personal use only. You may not authorise others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. You are responsible for keeping your user name and password(s) confidential.

    Permission is granted to temporarily download one copy of the materials (information or software) on my-cpd's website for personal, non-commercial transitory viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:

    • modify or copy the materials;
    • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    • attempt to decompile or reverse engineer any software contained on my-cpd's website;
    • remove any copyright or other proprietary notations from the materials; or
    • transfer the materials to another person or "mirror" the materials on any other server.

    This licence shall automatically terminate if you violate any of these restrictions and may be terminated by my-cpd at any time.     4. Limitations

    To the maximum extent permitted by applicable law, in no event shall my-cpd or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on my-cpd's website, even if my-cpd or a my-cpd-authorised representative has been notified orally or in writing of the possibility of such damage.

    The materials appearing on my-cpd's website could include technical, typographical, or photographic errors. my-cpd does not warrant that any of the materials on its website are accurate, complete, or current. my-cpd may make changes to the materials contained on its website at any time without notice. my-cpd does not, however, make any commitment to update the materials.

    The Services may contain links to web sites of third parties, including without limitation, advertisers, which are not under the control of my-cpd, and my-cpd is not responsible for the content of any linked site or any link contained in a linked site, or any changes or updates to such web sites. my-cpd has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by my-cpd of the site. Use of any such linked website is at the user's own risk.

    7. Fees and payment

    This agreement will become effective upon your acceptance of the Agreement, by your use of the Site and Services and will remain in full force and effect unless and until terminated hereunder. By opening a my-cpd account you agree to pay my-cpd the monthly or annual subscription fees indicated for that service. Payments will be charged on the day you sign up for a my-cpd account and will cover the use of that service for an annual period as indicated.

    my-cpd reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Your my-cpd account can be cancelled by you at any time on 30 days written notice to my-cpd.

    8. Refunds, cancellation and renewal

    my-cpd licence/subscription is non-refundable and non-transferable.

    You may cancel your licence/subscription to the Service at any time during the term of such registration or subscription, or any renewal period by sending a notice of cancellation to my-cpd, such notice being effective upon our receipt. Your subscription will terminate at the end of the subscription term for which you have paid and you will not receive any refund for any unused days of such subscription term. Please note that if you paid your subscription or renewal using a multi-part payment option, you may only cancel your subscription or renewal after the final payment has been paid.

    You may cancel the Agreement within seven (7) working days after the confirmation of your licence/membership to any of the Service(s) by using the communication method set out in this section and receive a full refund.

    Upon receipt of a request to cancel the Agreeement, users have 60 days to download/copy all my-cpd data to their own system(s) before the account is suspended. We will communicate your renewal period 30 days prior to the end of your licence/subscription, to you by email.

    9. Credit Card security

    By opening a my-cpd account you agree to pay my-cpd the monthly or annual subscription fees indicated for that service. Payments will be charged on the day you sign up for a my-cpd account and will cover the use of that service for a monthly or annual period as indicated.

    my-cpd reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Your my-cpd account can be canceled by you at any time on 30 days written notice to my-cpd.

    10. Uploading material

    If you choose to upload material to your my-cpd account, you are entirely responsible for the content of, and any harm resulting from, that material. That is the case regardless of whether the material in question constitutes text, graphics, an audio file, or computer software. By uploading , you represent and warrant that:

    • the uploading, copying and use of the material will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;
    • if your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the material, or (ii) secured from your employer a waiver as to all rights in or to the material;
    • the material does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content.

    my-cpd reserves the right, but has no obligation, to monitor the information or material you submit to the Services. my-cpd will have the right to remove any such information or material that in its sole opinion violates, or may violate, any applicable law, either the letter or spirit of this Agreement, or upon the request of any third party.

    11. Governing Law

    You agree that you will only use the Services in a manner consistent with this Agreement and any and all applicable local, state, national and international laws and regulations. Registration for, and use of, the Services are void where prohibited. To the extent that the Services are not legal in your jurisdiction, you may not use the Services.

    Any claim relating to my-cpd's website shall be governed by the laws of England, Wales, Scotland and Northern Ireland without regard to its conflict of law provisions.

    This Service may not be used where prohibited by law.

    This Agreement does not create any rights under the Contracts (Rights of Third Parties) Act 1999 which are enforceable by any person who is not a party to this Agreement.

    12. Communication and Privacy

    In accordance with our privacy statement, we may use your email address to send you messages notifying you of important changes to the Service, special offers and reminders. Further we may contact you by telephone if you voluntarily provide us with your telephone number, in order to communicate with you regarding our services. If you do not wish to receive such email messages or telephone calls, please refer to our Privacy Policy.

    This agreement is bound by the terms and conditions of the of the my-cpd Privacy Policy. My-cpd's data protection registration number is Z2128551 as stored with the Information Commissioner's Office (ICO)
